What is EOTAS?

EOTAS refers to a formal education provision outside a conventional school or college. It is designed to support students when school attendance is inappropriate due to their specific educational, medical, or emotional needs. Governed by Section 61 of the Children and Families Act 2014, EOTAS is arranged through the local authority as part of an Education, Health, and Care Plan (EHCP) and requires a thorough assessment to ensure it best serves each student's needs.

Key Difference: Unlike Elective Home Education (EHE), EOTAS is a legally recognised provision where the local authority remains responsible for the child’s education, including all provision listed in Section F of the EHCP.

Understanding Local Authority Responsibilities for EOTAS
Under the SEND Code of Practice (Paragraph 10.39), local authorities must ensure that suitable education is provided for every child who cannot access school. “Suitable education” is defined as efficient education appropriate to the child’s age, abilities, and any SEND they may have. EOTAS is typically considered full-time unless a reduced level is deemed more beneficial for the student’s health or well-being.

Local authorities are legally required to secure and fund any EOTAS provisions outlined in Section F of the EHCP, and they must assess whether school-based education is unsuitable based on factors such as:
